Welcome to Pop Zero® Popcorn! We’re thrilled you’ve decided to join our community of popcorn lovers. Please read these Terms & Conditions carefully before using our website, buying our products or interacting with us in any way.

By using our website, purchasing our popcorn or engaging with our brand, you agree to be bound by these Terms. If you don’t accept all of these Terms, you shouldn’t use this website or buy from us. We reserve the right to update these Terms at any time, effective immediately upon posting. An updated version will always be available on this page. It’s your responsibility to make sure you’ve read the latest version.

1. Definitions

“Pop Zero® Popcorn”, “Pop Zero”, “we”, “us” – refers to the Pop Zero brand, website, products and employees.

You” – refers to customers, website users and anyone else who interacts with Pop Zero.

Website” – means the website located at popzero.shop and all associated web pages.

Products” – means all popcorn, merchandise and services offered for sale on our Website or through other authorized channels.

Order” – means any Products you purchase from us.

Account” – means the optional user account you create on our Website to store information and interact with us.

2. Using Our Website

Our Website and its Contents are intended solely for personal, non-commercial use. You may download or print portions of the Content for this purpose, but you may not modify or further reproduce the Content. Although we want you to have an awesome experience, there are some things you shouldn’t do, including:

  • Using our Website or Content for any illegal purpose.
  • Violating laws related to copyright, trademark, privacy or other rights.
  • Scraping, mining, harvesting, caching, extracting, indexing or duplicating any data on our Website.
  • Attempting to gain unauthorized access to our Website or backend systems.
  • Posting spam, ads, links to malicious websites, or other inappropriate content.

We reserve the right to suspend, ban or delete any Account if we believe you’ve violated these Terms. We also reserve the right to delete or modify any Content on our Website at our sole discretion.

Our Website may contain links to third party websites. Those sites may have their own terms and privacy policies over which we have no control. We don’t endorse any third party websites or accept liability for their content or use.

3. Intellectual Property

Our Website design, text, graphics, interfaces, logos, sounds and artwork, along with our Products and their packaging are protected by copyright, trademark and other laws. Nothing in these Terms gives you permission to use our intellectual property for any reason. You agree not to remove any copyright or other notices from material you’ve printed or downloaded from our Website.

4. Accuracy of Information

We strive to give you useful, accurate information about our Products. However, we don’t warrant that all Product descriptions, prices, Photos or other Website Content is 100% error-free. If you spot any errors, please let us know and we’ll make corrections as soon as possible.

5. Placing Orders

We want your ordering experience to be awesome. To place an Order, just follow the steps on our Website:

  1. Select your Products – Add them to your cart after reviewing details like price, size, flavor, etc.
  2. Enter your information – Give us your name, shipping address, email, phone number and payment details.
  3. Confirm your Order – Carefully review your cart before submitting your Order.

Once you submit an Order by clicking “Complete Purchase”, we’ll send an email confirming receipt. This doesn’t mean your Order is accepted. We reserve the right to reject any Order, such as if we’re out of stock on an item or can’t verify your payment. We’ll let you know if we cancel an Order and refund your payment.

Keep your confirmation email for your records. It will contain details like expected delivery dates, tracking info, and policies like returns/exchanges. If you don’t get a confirmation within 24 hours, please contact us ASAP so we can sort out what happened.

6. Prices & Payment Processing

All prices shown are in U.S. dollars. We try to display accurate price info, but errors may occur. If we discover a pricing error, we may cancel your Order and let you know. In some cases we may choose to honor incorrect pricing at our discretion.

We accept most major credit cards, along with PayPal and Apple Pay. Just enter your info during checkout. Your card will be authorized when you submit your Order, then charged when it ships. If you pay with PayPal or Apple Pay, your account will be charged immediately.

If a charge is rejected or your payment fails, we may cancel your Order. You agree to pay all reasonable costs we incur to collect any overdue amounts.

7. Sales Tax

If you buy Products on our Website, you may be charged state and local sales tax based on your shipping address and the tax rates in effect at the time. These taxes will be added automatically at checkout.

When you provide a billing/shipping address, you authorize us to use that info to determine your tax obligation. We rely on tax rate data from Avalara and other third-parties. We aren’t responsible for auditing or verifying this data. If you feel we’ve made a tax mistake, reach out to [email protected].

8. Shipping & Delivery

We offer standard shipping on all Orders within the continental U.S. We can’t currently ship outside the U.S.

Delivery dates shown on our Website are estimates only. Your Order will ship within 2-5 business days after we confirm and accept it, then transit time varies based on your location. We’ll email you tracking info when it ships so you can monitor progress.

Certain situations like bad weather or logistics issues can cause delays, so we don’t guarantee delivery by a certain date. If your Order will be late, we’ll reach out with an updated estimate. Feel free to contact us anytime if you have questions or concerns about delivery.

We’ll try to deliver your Order in the most secure way possible. If nobody’s available to accept it, the carrier may leave it or choose a safe spot at their discretion. We aren’t liable for stolen packages or any damage after delivery.

If your Order never arrives, let us know so we can investigate with the carrier. If it’s truly lost, we’ll do our best to make it right by you.

9. Returns & Exchanges

We want you to absolutely love our Products! If you’re not 100% satisfied with your Order for any reason, you can return it for a full refund or exchange within 30 days of receiving your shipment.

To return an Order:

  1. Contact our Customer Experience team at [email protected] to let us know you’ll be making a return and why.
  2. Repackage the Order securely with all original contents.
  3. Mail the return package to:

We’ll refund your original payment once we receive and inspect the return, usually within 7 days. Please allow extra transit time for us to receive your package.

If you’d prefer an exchange instead, let us know and we’ll ship your replacement Order ASAP. We’ll email you a prepaid shipping label for exchanges, so you don’t pay shipping twice!

We can’t accept returns or exchanges if the Products show signs of damage or excessive use. If you think an item is defective, please contact us ASAP so we can evaluate the situation.

10. Promotions & Discounts

We love offering deals and promos! Any promotion we offer is valid for the stated time only while supplies last. Rain checks or retroactive price adjustments aren’t available.

Discounts generally can’t be applied after you’ve placed an Order. You’ll need to cancel and re-order if you want to claim an offer. Combining multiple promos on one order is also prohibited unless stated otherwise.

Free gifts, samples and bonus items automatically included in your Order don’t have cash value. You can’t return them separately without also returning the Products they came with.

We reserve the right to deny promotions, impose limitations, or revoke discounts resulting from unauthorized use or errors. If we see you’re abusing promos or acting unfairly, we may revoke your ability to claim current/future offers.

11. Sweepstakes & Giveaways

We may run sweepstakes, contests or giveaways through our Website, email newsletters or social media. Each promotion has its own official rules, so please read them carefully before entering or claiming prizes. We aren’t responsible for any unclaimed prizes, and reserve the right to deny payout for improper entry, fraud or other misuse.

12. Your Account

Creating an Account on our Website is optional. You can place Orders as a guest without one. If you do create an Account, you agree to:

  • Give accurate info
  • Keep your login credentials secure
  • Promptly update any info changes
  • Fully log out after each session

We aren’t liable for any damage arising from unauthorized access if you fail to follow the above.

You’re free to delete your Account anytime by emailing [email protected]. We may also delete Accounts that are inactive for extended periods.

13. Our Liability

We work hard to run an awesome business and make you smile, but there are some limits on our potential liability:

  • We aren’t liable for lost profits or consequential damages related to your Order, use of our Website or Account.
  • We don’t accept liability beyond the value of any defective Product, or the amount of any other economic loss you suffer from use of our Website or Account.
  • Claims must be made within 6 months after the basis for the claim is known.
  • We’re only responsible for our own content on the Website. We aren’t liable for user reviews or comments, or third party ads, sites etc.
  • Some states don’t allow limits on certain implied warranties or consumer rights, so some of the above limits may not apply.

14. Resolving Disputes

We want to address any concerns you have! First contact our Customer Experience team so we can try to work it out. We’ll make every reasonable effort to fairly resolve the issue.

If we can’t come to an agreement informally, you agree to resolve disputes through small claims court or individual arbitration instead of a jury trial or class action. Arbitration is more informal than court, and seeks quick rulings instead of long legal battles.

The arbitrator can only award the same damages as a court could, and can’t group together claims to create a class action. For any arbitration, we’ll pay your initial filing fee over $100. You’re responsible for other fees unless the arbitrator rules otherwise.

If you prefer, you can also file a claim with your local small claims court if it’s within its jurisdictional limits. These are often easier than arbitration and only cost a small filing fee.

15. Governing Law

These Terms are governed by the laws of Tennessee, without respect to conflict of law rules. That means any dispute or lawsuit must use TN state law regardless of where you live or use our Website.

16. Severability

If any part of these Terms is found invalid or unenforceable by any court, that provision will be severed and the rest of these Terms will remain fully valid and enforceable.

17. Changes

We may occasionally update these Terms. When we post updated Terms, we’ll change the “last updated” date above. Outdated versions will always remain accessible on this page so you can compare.

Substantial changes will be handled as follows:

  • For existing customers, we’ll notify by email at least 21 days before changes take effect.
  • For new customers, new Terms apply immediately upon account creation or first Order.

Using our Website or submitting an Order after we’ve posted updates means you agree to the new Terms. If you don’t accept them, stop using our Website and don’t place any Orders.
